Sometimes, married same-sex couples here in New York adopt a child. When a New York same-sex couple with an adopted child gets divorced, one of the things that will need to be figured out in their divorce case is what sort of arrangement will be established regarding child custody.
Recently, a divorce case involving a celebrity same-sex couple with an adopted child has arisen here in New York.
Comedian and television personality Rosie O'Donnell and her wife are the celebrity couple in question. The two got married in New York in 2012. They separated in November 2014. Last week, O'Donnell filed court papers asking for a divorce. The papers were filed in a court in Manhattan.
The adopted child O'Donnell and her wife have is two years old. The two have shared custody of the child since their separation. One wonders if they will continue in this vein and set up a shared child custody arrangement in their divorce, or if some other custody arrangement will end up being established in the divorce.
Among the many child custody issues that need to be determined when a same-sex couple with minor children gets divorced is whether one of the parents will get primary physical custody of the kids or if some sort of joint physical custody arrangement will be put in place. What arrangement is ultimately reached in a custody matter in a same-sex divorce can be very impactful. What custody arrangement is best-suited for a given divorcing same-sex couple can be influenced by a wide range of different factors.
