Divorcing same-sex couples can run into problems

The U.S. Supreme Court recently heard arguments on the Defense of Marriage Act. Many people are anxious to hear what the justices will ultimately decide. The outcome could have an impact on same-sex marriage and divorce.

Currently, only nine states recognize same-sex marriage. Same-sex couples can move to states where same-sex marriage is not recognized. However, they may run into problems if they decide to part ways. In order to be granted a divorce, couples have to move to states that recognize same-sex marriage and live there for six months to two years.

In 2011, the Marriage Equality Act was signed into law in New York. Since then, same-sex couples in New York have been given the same privileges as opposite-sex couples. They also have the same rights when it comes to divorce.

No matter the couple, going through a divorce can be challenging. In addition to settling property division matters and working through child custody and child support issues, couples must also deal with the emotions that come with divorce. Some people may experience moments of anger and frustration as well as sadness and anxiety about the future.

People usually want to put their divorce behind them so that they can move forward with their life and adjust to their new normal. In order to do that, people in New York and others elsewhere are usually best served working with an experienced divorce attorney. An attorney can help people sort through important issues in a timely manner.
